Casper Moves to Include Vaping in Smoking Restrictions

Casper city officials plan to update local regulations. Moreover, the new rules will treat vaping devices the same as traditional cigarettes under existing smoking bans. The proposed vaping restrictions aim to close gaps in current legislation. Additionally, they will strengthen protections for young people.

The Casper City Council examined the planned changes during Tuesday’s work session. City Attorney Eric Nelson outlined how existing rules have failed to keep pace with evolving nicotine delivery methods.

Closing the Vaping Restrictions Loophole

Current municipal code prohibits smoking in indoor public spaces and workplaces. However, it makes no specific mention of e-cigarettes or vaping equipment. Consequently, this omission has created confusion about where e-cigarette regulations apply. Furthermore, it has led to inconsistent enforcement in venues where conventional smoking is already forbidden.

“If you were to poll people in the community, I think most would probably think it’s already not permitted,” Nelson explained. “But when you look at the ordinance definitions of smoking devices, it really doesn’t cover [vaping].”

The amendments would explicitly ban vaping devices in all indoor public facilities. These facilities are currently designated as smoke-free zones.

Age Restrictions for E-Cigarette Regulations

Beyond indoor vaping bans, the proposals seek to align hemp-derived and THC-containing products with nicotine regulations. Federal and state law already prohibits nicotine sales to anyone under 21. Nevertheless, hemp and THC products currently fall outside this framework within city code.

The updated ordinances would establish 21 as the minimum age for purchasing all such products. Therefore, this creates uniform standards across different substance categories.

Council members indicated strong support for the age-related provisions. “I’m totally on board with limiting it to 21-year-olds,” Councillor Pat Sweeney said. “I’ve thought all along that’s where it should be.”

According to the CDC, youth vaping rates have fluctuated significantly in recent years. In fact, the agency reported that 10% of high school students used e-cigarettes in 2024. Thus, age restrictions remain a critical tool for communities.

Modernising Public Health Standards

Nelson characterised the changes as necessary updates. Specifically, they match contemporary understanding of nicotine delivery systems and their health implications. The amendments would provide clearer guidance for businesses selling vaping products. In addition, they help the public understand where usage is permitted. Similarly, they give law enforcement officials better tools for consistent application.

The vaping restrictions represent a pragmatic response to technology. This technology has outpaced existing regulatory language. City officials will incorporate e-cigarettes into established frameworks rather than creating separate rules. As a result, they aim to simplify compliance and reduce confusion.

Next Steps

City Council will hold a public hearing on the proposed amendments. Afterwards, officials will consider a formal first reading of the ordinance. This process allows residents and business owners to voice concerns or support before any final vote.
