Portland Man Sues Cannabis Shop Over THC Overdose Hospitalisation

A Portland man has filed a lawsuit against a cannabis shop, alleging that a staff member’s advice on THC dosing led to a severe overdose and subsequent hospitalisation. Skye Fitzgerald, a novice cannabis user, experienced alarming symptoms such as vomiting, muscle spasms, shortness of breath, and an inability to walk after consuming what amounted to 40 milligrams of THC from a syrup recommended by the shop’s employee.

The lawsuit claims Fitzgerald was advised to take “about a capful” of the potent syrup, which dramatically exceeds guidance in other regions. By comparison, British Columbia recommends first-time users consume no more than 2.5 milligrams of THC. After following the store’s instructions, Fitzgerald faced a catalogue of health issues, including an elevated heart rate and significant muscle weakness, requiring emergency care. Doctors diagnosed him with a THC overdose.

The shop, Arcanna, has denied responsibility, stating that their employee suggested only “a few drops” and that product serving sizes are regulated by the state. However, Oregon lacks strict dosage guidelines for certain cannabis products, leaving new users vulnerable to dangerous outcomes. The shop stopped selling the product after the incident.

This case highlights growing concerns about the unchecked potency of modern cannabis products and the risks they pose to individuals unfamiliar with their effects. Experts warn of the unpredictable nature of THC’s impact, particularly at high doses, reinforcing the need for consumers to approach cannabis use with extreme caution.
