Efforts to bring a medical marijuana pharmacy to St. John the Baptist Parish have sparked controversy, leading to a lawsuit over zoning disputes. Despite Louisiana legalising medical marijuana nearly a decade ago, local officials in this parish have blocked plans for a cannabis dispensary, citing zoning regulations.
Permit Denial Sparks Lawsuit
Omar Pecantte, owner of Green Leaf Dispensary, intends to open a medical marijuana pharmacy on Belle Terre Boulevard in LaPlace, but his permit request was denied. St. John officials argue that their zoning ordinances do not specifically permit cannabis dispensaries. This stance contrasts with other parishes in Louisiana, where medical marijuana pharmacies are classified as regular pharmacies under land use regulations.
After paying a permit fee of $1,861 in December, Pecantte believed the matter was resolved, only to face further delays. Frustrated, he filed a lawsuit in January, seeking $300,000 in damages, alleging lost revenue due to the parish’s actions.
Zoning Rules Create Challenges for Medical Marijuana Pharmacy
The dispute hinges on the parish’s zoning provision that prohibits any business use not explicitly listed. Critics note this interpretation unfairly restricts access for medical marijuana patients. Kevin Caldwell, an advocate from the Marijuana Policy Project, pointed out that St. John Parish has over 1,500 registered medical marijuana patients who rely on local access to their medication.
Debate Over Medical Marijuana Pharmacy Divides Community
While other parishes have adapted their policies to include cannabis dispensaries, St. John officials have chosen to defend their stance in court rather than revise their zoning laws. Some argue that denying the pharmacy approval is harmful to patients and the local economy.
Pecantte’s case is ongoing, with further legal proceedings expected in the coming months. Supporters highlight the need for clearer regulations to support legitimate businesses while addressing community concerns about cannabis dispensaries.
