Kratom Overdose Death: Springfield Mother Sues Manufacturers

A heartbroken mother from Springfield is taking legal action against multiple kratom manufacturers following her son’s tragic kratom overdose death at the age of 38. As a result, the case has sparked renewed debate about herbal supplement regulation across Missouri and the United States.

Health authorities have consistently raised alarm bells about the dangers of kratom products. Moreover, the Food and Drug Administration reports serious adverse health effects linked to these substances. These include fatalities, liver toxicity, seizures, and substance use disorder. In fact, FDA data from 2021 reveals troubling numbers: 20 deaths and 20 hospitalisations tied to kratom products. Each represented 27% of reported adverse events that year.

Three years ago, Deborah Brossett discovered her son Breck unresponsive. The moment would alter her life forever. As a registered nurse, she attempted CPR. However, her hands trembled so violently she struggled to dial emergency services. “It took me three times just to dial 999,” she recalled. “I was just shaking and couldn’t get the numbers.” Even now, her voice still carries the weight of that morning.

Later, toxicology reports confirmed the cause. Kratom, an herbal extract from a Southeast Asian plant, may have led to this kratom-related fatality. The revelation shocked the family. Despite his healthy lifestyle, they described Breck as exceptionally health conscious. In their eyes, he was the last person they’d expect to struggle with substance abuse.

“He was a very clean eater,” Brossett explained. “My son intermittently fasted, worked out every day from 4:30 to 5:30.” At 5’11” and 188 pounds with about 6 per cent body fat, Breck embodied discipline. Through her words, she paints a picture of her son’s dedication to health.

How Kratom Products Became Deadly Substances

Kratom has gained popularity as a natural remedy for pain relief and depression. In addition, some users report increased energy levels. Nevertheless, legal experts argue that modern manufacturing processes have transformed the plant into something far more dangerous.

Nick Brand represents Brossett in her lawsuit filed this September against kratom companies. He stated his concerns plainly: “What we’ve done is allow the natural nature of the original product to overshadow the fact that it’s being manufactured into a deadly product.”

According to Brand, manufacturers either increase potency levels dramatically or extract 7-hydroxymitragynine. This is the metabolised form of kratom’s active compounds. Furthermore, Breck’s autopsy revealed alarming findings. The toxicology report underscores the severity of this kratom overdose death.

“He had 3,400 nanograms per millilitre of the active substance in his blood,” Brand disclosed. “That is extremely high, significantly higher than levels typically found in fatalities.”

Currently, the attorney handles several cases involving kratom-related fatality incidents. Clearly, Breck’s tragedy is far from isolated. Meanwhile, the Centers for Disease Control and Prevention paint a worrying picture. Between 2016 and 2017 alone, kratom was linked to hundreds of overdose deaths nationwide.

Brossett’s legal action coincides with broader regulatory concerns sweeping across Missouri. Just last week, Missouri Attorney General Catherine Hanaway announced a statewide investigation. As a result, six companies selling kratom products are now under scrutiny.

“We are deeply concerned that Missourians are being sold drug-like substances under the guise of harmless supplements,” Hanaway stated firmly. “With no FDA approval, no safety testing, and in some cases no meaningful disclosure of what these products actually contain.” She added, “Companies that mislead consumers or place them at risk will be held accountable.”

Despite mounting evidence of harm related to kratom overdose death cases, federal oversight remains largely absent. Indeed, the Food and Drug Administration has not approved the substance. Additionally, kratom companies don’t subject their products to the rigorous safety testing required for pharmaceutical products.

A Mother’s Campaign To Prevent Future Tragedies

For Brossett, the lawsuit represents far more than legal accountability. Rather, it’s a campaign to prevent other families from experiencing a kratom-related fatality. She believes that raising public awareness and securing legislative action would honour her son’s memory.

“By us doing this and us joining together and being loud, if we save one person, we’re saving a whole family,” Brossett spoke with quiet determination.

Meanwhile, medical experts continue calling for stronger oversight. Dr Natalie Klag from The Ohio State University Wexner Medical Centre warns about kratom’s easy availability. Consequently, it communicates a misleading level of safety. This often leads people to delay seeking proper medical management when their use spirals out of control.

Where federal regulation has lagged, state lawmakers are stepping in. For instance, Ohio Representative Brian Lorenz explained his state’s approach. “This bill will keep Ohioans safe because it ensures any kratom product sold in Ohio meets quality standards.”

Increased public attention could pressure lawmakers to act, Brand emphasised. “Increasing the public’s awareness of the dangers of these products, particularly to get the legislature’s attention, is really important,” he highlighted.

Notably, attorneys for the kratom companies named in the lawsuit did not respond to requests for comment.

According to his mother, Breck used kratom for three to four years before his kratom overdose death. She described him as “a good Christian” who never abused drugs or alcohol. In her words, he was “the person least likely to become an addict.”

His story highlights the deceptive nature of substances marketed as natural alternatives. Although they appear harmless, they can carry hidden dangers. Specifically, manufacturing processes concentrate active ingredients to potentially lethal levels. This can result in kratom-related fatality.

As the investigation unfolds, Brossett’s case proceeds through Missouri courts. Meanwhile, the spotlight on kratom regulation intensifies. The outcome could determine whether other families face similar tragedies. Moreover, it may also bring stronger safeguards to protect consumers from inadequately tested herbal supplements.
