After years of advocacy, a significant victory has been achieved in the fight against unregulated intoxicating substances. The federal ban on hemp derived THC products, including Delta 8, has finally passed Congress, but the battle is far from over.
Jordan Davidson, government affairs director at Smart Approaches to Marijuana, recently outlined what advocates need to know about this watershed moment and the challenges that lie ahead.
How The 2018 Farm Bill Created The Hemp Derived THC Crisis
The issue began with the 2018 Farm Bill, which legalised hemp for industrial purposes such as rope and clothing production. Lawmakers defined hemp as cannabis containing less than 0.3% Delta 9 THC by dry weight, a seemingly modest threshold that proved catastrophic.
“The difference between these products and marijuana is like Coke and Pepsi,” Davidson explained. “In some cases, it’s almost exactly the same.”
What emerged next shocked public health experts. A multi-billion pound industry producing both synthetic compounds, created through processes involving battery acid and pool chemicals, and “natural” Delta 9 THC products that exploited the weight-based loophole flooded the market. A single beverage could legally contain over 1,000 milligrams of THC, with just 5 milligrams considered a standard dose.
The proliferation of intoxicating hemp products created a public health crisis. Within a few short years, more than one in ten high school seniors had used these substances. Emergency room admissions for young children rose by thousands of percent, with tragic cases including a four-year-old Virginia boy who died after consuming Delta 8 gummies.
Why Closing The Intoxicating Hemp Loophole Took Seven Years
Despite overwhelming evidence of harm, closing the hemp derived THC loophole took nearly seven years of intensive advocacy. Several factors caused the delay.
Ideologically, some members of Congress, including Rand Paul and Thomas Massie, opposed restrictions on libertarian grounds. Meanwhile, the hemp industry hired powerful lobbying firms and deliberately conflated intoxicating products with legitimate non-intoxicating hemp uses.
“Their key argument was muddying the waters,” Davidson noted. The industry claimed that restricting intoxicating hemp would inevitably destroy the CBD market and industrial hemp farming operations.
Major corporations complicated matters further. Target began selling these beverages, Door Dash and Edible Arrangements delivered them, and even segments of the marijuana industry split on the issue, with some operators selling hemp derived THC whilst others opposed it.
The turning point came when Senator Mitch McConnell, who had championed the 2018 Farm Bill, became convinced of the need for reform. His support proved decisive in securing the ban’s passage, with 74 senators voting to keep the prohibition language in the appropriations bill.
The One Year Implementation Period For Hemp Derived THC Ban
The new law provides a one year delay before the ban takes effect, a compromise necessary to secure passage. During this critical period, the hemp industry will undoubtedly fight to extend the delay or reverse the prohibition entirely.
“They’ve hired even more lobbyists,” Davidson warned. “They’re going to try to work in every package that moves through Congress to get a provision extending the delay.”
However, he remains optimistic that such efforts will fail. “People are really annoyed about this issue on Capitol Hill. They’re fed up with it. Legislators are done.”
The relentless lobbying by hemp industry representatives to keep intoxicating products accessible to children has generated significant ill will amongst legislators, potentially undermining their own advocacy efforts.
What Advocates Must Do Now About Intoxicating Hemp Products
For those committed to protecting communities from these harmful substances, the work continues on multiple fronts.
At the federal level, advocates should determine how their representatives voted on this issue. In the Senate, members took a direct vote on the hemp derived THC ban, whilst in the House, the prohibition appeared in government funding legislation, making individual positions less clear.
Crucially, advocates must contact their elected officials to resist industry pressure for delays or reversals. Personal stories remain the most powerful advocacy tool.
Davidson recounted how one family’s testimony during a Capitol Hill meeting prevented their congressman from signing an industry letter opposing the ban. “Stories are much more powerful than just raw data,” he emphasised. “Members of Congress need to put a face to an issue.”
The State Level Challenge
Whilst federal action is significant, state enforcement will determine whether this victory translates into genuine public health protection. With 8,000 registered retailers in Texas alone, twice the number of McDonald’s and Starbucks combined, enforcement represents a substantial challenge.
Smart Approaches to Marijuana is now working state by state to secure local prohibitions. Ohio has already moved forward with legislation crediting the federal ban as impetus for action.
However, states with legalised marijuana may adopt a compromise framework allowing hemp derived THC sales only in licensed dispensaries rather than petrol stations and corner shops. Whilst not ideal, this would represent substantial harm reduction compared to the current situation.
“If you already have dispensaries in your community and they’re already selling THC products, they’re just going to be stocking their shelves with different brands,” Davidson acknowledged. “That’s a far better outcome than having these products sold at petrol stations.”
Why The Politics Around Intoxicating Hemp Differ From Marijuana
One reason for cautious optimism is that political dynamics surrounding intoxicating hemp differ markedly from traditional marijuana debates. The bipartisan opposition, demonstrated by the 74 to 26 Senate vote, suggests enforcement may actually materialise.
“Can you imagine 74 senators voting to affirm a nationwide ban on weed?” Davidson asked. “Probably not. But it happened for these products.”
The extensive negative media coverage, emergency room admissions, and deaths associated with hemp derived THC have created momentum that traditional marijuana legalisation efforts have never faced in reverse.
Major retailers like Target will likely comply with the federal prohibition rather than risk legal liability. “I don’t think it’s worth the risk for these big companies to continue selling” products that amount to controlled substances, Davidson argued.
Countering The “Dead Of Night” Narrative
Industry advocates have attempted to portray the ban as secretive legislation slipped through “in the dead of night.” This characterisation is demonstrably false.
Smart Approaches to Marijuana included the prohibition in the House Farm Bill nearly two years ago. The measure appeared in previous appropriations cycles and has been the subject of extensive public advocacy. Allied organisations have written numerous articles and social media posts documenting their efforts for years.
“This has been a public fight,” Davidson stated firmly. “It’s not my fault if you haven’t wanted to pay attention to an issue that has been very public.”
The inclusion in government funding legislation reflects standard congressional procedure, not subterfuge. Lawmakers incorporate fully developed appropriations bills into continuing resolutions to avoid endless piecemeal votes on every issue.
The Road Ahead For Hemp Derived THC Advocacy
As the one year countdown begins, advocates cannot declare victory and move on. The hemp industry’s resources and determination mean constant vigilance is essential.
Coordination between national organisations and local advocates will prove critical. Davidson revealed he was receiving text messages requesting contacts in various states even during the interview, underscoring the ongoing nature of this campaign.
“We need all the backup that we can get to put the nail in the coffin of this intoxicating hemp industry,” he said.

Federal legislation is merely the foundation. State level action and robust enforcement will determine whether this victory delivers lasting change.
The hemp derived loophole may be closing, but ensuring it stays closed will require sustained effort, strategic advocacy, and the continued willingness of families to share their stories with those in power.
